These Terms and Conditions (“Terms”) govern your access to and use of the website located at lovepupfoundation.org (the “Site”) and any related content, features, applications, forms, or services offered by #LovePup Foundation (collectively, the “Services”). By accessing or using the Site, submitting an application, making a donation, registering for an event, or otherwise interacting with our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please discontinue use of the Site and Services.
#LovePup Foundation (“#LovePup,” “the Foundation,” “we,” “us,” or “our”) is a 501(c)(3) nonprofit dog-rescue organization based in Scottsdale, Arizona. We are recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code, and our federal tax identification number is available upon request through our Contact page.
You must be at least 18 years old, or the age of majority in your state of residence, to submit an adoption, foster, or volunteer application, make a donation, or enter into any agreement with the Foundation through the Site. By using the Services, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms. Minors may browse informational areas of the Site only under the supervision of a parent or legal guardian.
You may use the Site for lawful, personal, non-commercial purposes related to learning about our mission, our dogs, our events, and how to support our work, including submitting applications, making donations, and communicating with us. You agree to provide accurate information whenever the Site asks for it and to comply with all applicable local, state, and federal laws while using the Site.
When using the Site, you agree not to:
We reserve the right to restrict or terminate any person’s access to the Site or Services for conduct that we believe, in our sole discretion, violates these Terms or is otherwise harmful to the Foundation, our dogs, or our community.
The Site allows you to submit applications to adopt, foster, or volunteer with #LovePup Foundation. Submitting an application is a request, not a guarantee. All applications are reviewed and approved or denied at the Foundation’s sole discretion, based on factors that may include household environment, experience, references, and the needs of a particular dog or program.
You agree to provide complete and accurate information on any application, and to promptly update us if that information changes. Providing false or misleading information may result in denial or revocation of an approved application or placement.
If your application is approved, the placement of a specific dog with you as an adopter or foster, and your role as a volunteer, will be governed by a separate adoption agreement, foster agreement, or volunteer agreement, as applicable. If any provision of a signed adoption, foster, or volunteer agreement conflicts with these Terms, the terms of that specific agreement will control with respect to the placement or role it covers.
Our dogs are living animals, not products, and every dog is an individual. We share the history, health information, and behavioral observations we have in good faith and to the best of our knowledge at the time, whether that information comes from a prior owner, a partner shelter, a foster home, or our own team’s observations. However, we cannot guarantee a dog’s temperament, behavior, health, or future compatibility with your household, other pets, or children, and a dog’s behavior may change once placed in a new environment.
Once a dog is placed with you as an adopter or foster, you assume responsibility for that dog’s care, supervision, and any interactions the dog has with people, other animals, or property, consistent with the terms of your adoption or foster agreement. We encourage every adopter to consult a veterinarian and, where helpful, a qualified trainer or behaviorist as part of welcoming a rescue dog into your home.
Donations made through the Site are voluntary contributions to support our mission. All donations are generally non-refundable, except where required by law or where we determine, in our sole discretion, that a refund is appropriate (for example, in the case of a processing error or duplicate charge). If you believe a donation was made in error, please contact us through our Contact page as soon as possible so we can review your request.
As a 501(c)(3) nonprofit organization, donations to #LovePup Foundation are generally tax-deductible to the extent allowed by law. We will provide donation receipts and acknowledgments consistent with applicable IRS requirements; please retain these records for your own tax purposes, and consult a tax advisor with specific questions.
If you have set up a recurring donation, you may cancel or modify it at any time by contacting us through our Contact page. Donations are processed by secure, third-party payment processors, and your payment information is subject to that processor’s own terms and privacy practices.
From time to time, we may offer #LovePup merchandise for purchase, including through a linked third-party order form (such as a Google Form) rather than a checkout process hosted directly on this Site. When you place a merchandise order, you are entering into a separate transaction, and shipping, fulfillment, and order-processing timelines may vary based on volunteer availability and vendor lead times. Any third-party platform used to process an order or payment has its own terms of service and privacy practices, which govern your use of that platform, and we encourage you to review them before submitting an order.
We periodically host or participate in adoption events, fundraisers, and community gatherings. If an event requires registration or RSVP, the information you provide will be used to plan for attendance and, where applicable, communicate updates about the event. By attending an in-person event, you agree to follow any posted rules, staff and volunteer instructions, and dog-handling guidelines, including keeping dogs leashed, respecting the space of other animals and attendees, and following the directions of Foundation staff or volunteers regarding any dogs present.
Events may be photographed or filmed for use in our marketing, social media, newsletters, and fundraising materials. By attending, you consent to being photographed or recorded in the general course of event coverage, unless you specifically notify our staff on-site that you do not wish to be photographed. Attendance at any Foundation event is voluntary, and you assume the risks ordinarily associated with attending an outdoor or public gathering, including being near dogs and other animals.
The Site, including its text, graphics, logos, photographs, videos, and the #LovePup Foundation name and marks, is owned by the Foundation or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive license to view and access the Site for your personal, non-commercial use. You may not reproduce, republish, distribute, modify, or create derivative works from any Site content, or scrape or systematically download Site content, without our prior written permission.
If you submit content to us, such as a testimonial, adoption story, photo, video, comment, or review, you grant #LovePup Foundation a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, edit, publish, and display that content in connection with our mission, including on the Site, in print materials, and on social media. You represent that you own or have the right to submit the content you provide, and that it does not infringe the rights of any third party.
The Site may link to or embed content from third-party websites and services, including social media platforms, mapping services, video platforms, email and newsletter providers, and donation-processing platforms. We do not control these third parties and are not responsible for their content, accuracy, availability, or privacy and security practices. Your use of any third-party site or service is subject to that party’s own terms and policies.
The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is complete, accurate, or current.
To the fullest extent permitted by law, #LovePup Foundation and its officers, directors, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or profits, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Nothing in these Terms is intended to limit any liability that cannot be excluded or limited under applicable law.
You agree to defend, indemnify, and hold harmless #LovePup Foundation and its officers, directors, employees, and volunteers from and against any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, your misuse of the Site, or your interactions with any dog placed with you or any other person in connection with our Services.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
We may update these Terms from time to time to reflect changes in our practices, programs, or applicable law. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.
