By accessing or using the #LovePup Foundation website (the “Site”) and any associated services, features, content, or applications (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must discontinue use of the Services immediately.
“Foundation,” “we,” “us,” or “our” refers to the #LovePup Foundation, its affiliates, officers, directors, employees, and agents.
“User,” “you,” or “your” refers to any individual or entity accessing or using the Services.
“Content” means any text, images, graphics, videos, audio, software, or other materials displayed, transmitted, or made available through the Services.
You must be at least 18 years old (or the age of majority in your jurisdiction) to access or use the Services. By using the Services, you represent and warrant that you meet this requirement and possess the legal right and capacity to enter into these Terms.

Donations: All donations are voluntary, non-refundable, and final, unless otherwise required by law or at our sole discretion.
Payment Processing: Transactions are processed by secure, PCI-compliant third-party processors. You agree to their terms of service and privacy policies.
Tax Receipts: Donation receipts will be issued in accordance with applicable tax laws. It is your responsibility to retain records for tax purposes.
Ownership: All Content and trademarks on the Services are owned by the Foundation or its licensors.
Limited License: Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Services.
Submission: By submitting any content (including comments, photos, testimonials), you grant the Foundation a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content in any media.
Responsibility: You represent and warrant that you own or have rights to all submitted content and that it does not violate any law or third-party rights.
Your privacy is important to us. Our collection and use of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms.
No Warranty: The Services are provided “as is” and “as available,” without any warranty of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Information Accuracy: We do not guarantee the accuracy, completeness, or reliability of any Content provided through the Services.

You agree to defend, indemnify, and hold harmless the Foundation and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or in any way connected with your access to or use of the Services or violation of these Terms.
The Services may contain links to third-party websites, services, or resources. We are not responsible for their content, accuracy, or practices. Your interactions with third parties are solely between you and that third party.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice. We will not be liable for any changes to the Services.
We may revise these Terms from time to time. The updated Terms will be effective as of the Effective Date indicated above or as otherwise specified. Continued use of the Services signifies your acceptance of the revised Terms.
Governing Law: These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles.
Dispute Resolution: Any dispute arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, to be held in Houston, Texas, unless otherwise agreed.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
These Terms, together with the Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and the Foundation regarding your use of the Services.
